What is FAR Part 135 for Business Aircraft Operations?

This post is one in a line of Private Jets VIP’s educational series that will help our VIP clients stay well informed and be able to make the right decision when chartering an aircraft.

Private Jets VIP works to educate it’s current and future VIP clients with regards to business air charter. At Private Jets VIP we feel that a well-educated charter client is a satisfied client. Business aircraft available for charter generally are operated under FAR Part 135. Some aircraft operators decide to operate under a FAR Part 135 certificate as opposed to Part 91. There are advantages and disadvantages associated with both arrangements; each operator must weigh its own needs and obligations when making this decision.

The principal advantage of operating under a Part 135 certificate is that an operator then can lease the aircraft to gain additional utilization of the aircraft and, therefore, offset the fixed costs of owning the aircraft. These commercial operations can be most beneficial and compatible if the aircraft is used infrequently by its owner.

Some disadvantages also exist. As a Part 135 operator, the company is a certificate-holding entity in the eyes of the FAA and must comply with specific requirements in regard to paperwork, maintenance and training. As a certificate holder, the operator is subject to additional surveillance from FAA inspectors and has less flexibility in conducting flight operations, e.g. legality of starting instrument approaches when weather is below minimums, takeoff minimums (there are none for Part 91), flying to airports with no weather reporting equipment, crew rest, etc.

Scheduling flexibility and control are more complex because aircraft may be obligated to lease or charter commitments. Insurance, accounting and tax considerations all will change under any lease or charter arrangement. Rather than obtaining their own FAR Part 135 certificate, some aircraft owners will place their aircraft on someone else’s Part 135 certificate. This is known as piggybacking, or managed charter.

The owner of the aircraft will pay for the conformance of the aircraft to the Part 135 regulations, but the 135 certificate holder will hold FAA operational control of the aircraft when conducting charter flights. Piggybacking situations can take many forms; therefore, key issues such as who supplies the crew, whose insurance policy covers, who dispatches flight when the aircraft is operated Part 91 for the owner of the aircraft, etc. must be addressed in advance and included in the air charter management agreements.

  • The trip dynamics must fall in line with the operator’s operating specifications, and any further Wyvern restrictions such as mountain airport restrictions.

There is no company that has all its crewmembers qualified. Therefore, it is important to know who the pilots are on each flight and not just rely on that fact that the company has been audited.

Private Jets VIP clients do not sacrifice safety when they choose private air charter over commercial airlines; in fact, business aircraft have compiled an outstanding safety record in recent years, comparable to or better than that of the airlines. Moreover, the level of control afforded to those choosing private aviation often increases the traveler’s sense of safety. Jet Certification

All aircraft selected by Private Jets VIP is owned or managed by FAA Part 135 certified suppliers “Operators”. For a jet to be included in Private Jets VIP’s “Preferred” list and selected for our VIP clients:

  • The aircraft must be under full operational control of a Private Jets VIP-certified operator
  • The aircraft must meet the profile and model type of those in the Private Jets VIP program
  • The Owner must carry appropriate level of insurance and up-to-date documentation
  • The aircraft must have current ARG/US-certified Pilot-in-Command and Second-in-Command certificates

Operator Certification

Prospective providers for Private Jets VIP undergo comprehensive examinations of both their operations and management. In order to be a certified Private Jets VIP aircraft provider, every operator must:

  • Meet the required safety standards of Aviation Research Group U.S. (ARG/US), and always maintain at least a Gold Rating*
  • Have current and up-to-date official regulatory documentation
  • Have proper insurance commitments and documentation
  • Execute and adhere to a “Private Jets VIP Provider Agreement”
  • Provide detailed pilot and crew information on an ongoing basis
  • Uphold continual maintenance and compliance with all Private Jets VIP criteria

How to Choose a Private Jet Charter Company

As the pace of your life accelerates, it’s clear that your time is becoming too valuable to spend waiting in airports for delayed flights to activities or meetings that had to be postponed until you arrived! You begin thinking about private jet charter — a faster, easier, more customized way to travel to your destination. Luckily, flying in a private jet is one of the safest and most luxurious ways to travel. Unlike commercial airlines, private jets fly in and out of smaller suburban airports that are closer to departure and destination points. Also, typically smaller airports do not have the long lines or delays passengers have come to expect at any of today’s large urban airports.

  • Look for VIP Client Service: Ideally, there should be a single person responsible for your trip. Also, live help should be available around the clock for if you must change your plans, make a special request, or ask a question. You will get a great sense of their level of service by how you are treated on the phone. Does the agent take time with you, ask questions to ensure they understand what is important to you, are they polite, and most importantly, are they responsive.
  • Select an Aircraft: Often, a charter company will provide pictures of an aircraft under consideration for a trip. Be warned, however, that pictures are deceiving and may not be current. The only way absolutely ensure the status of an aircraft is to view it personally.Also, because insurance levels can change at any time and vary by aircraft within the same fleet, it is important to ask for a copy of the insurance policy before each and every flight.
  • Check up on your Pilot: Find out what the provider’s standards are for minimum pilot hours. Different jet types require different pilot hours. Once you have chosen an aircraft, verify that the assigned pilot has the required number of pilot hours on that type of craft. Generally, each captain should have at least 5000 total flight hours and 300 hours in the specific aircraft type. Ask how often the pilots attend recurrent training in a full-motion simulator. Once every six months is considered ideal. Anything less, the pilot may not be as fesh as possible on the latest procedures.
  • Find Out How Much it Will Cost: As the details of your needs become more specific, you should be able to get a clear quote, not a vague estimate that leaves room for surprises on the final invoice. And always ask for a hard quote. Yes, ceratain things such as catering, ground transporation, and flight phone usuage are not known before the flgiht, but everything else should be a firm quote so you are not suprised by the final billing.
